KING'S BENCH DIVISION

LIBEL ACTION BY SIR ARTHUR CONAN DOYLE

DOYLE v. BOTTOMLEY AND OTHERS

(Before MR. JUSTICE AVORY)

A settlement was announced of a libel action brought by Sir Arthur Conan Doyle, the author, against Mr. Horatio Bottomley, the Phoenix Press, Limited, and L. Upcott, Gill, and Son, Limited.

Mr. HENN COLLINS, for Sir Arthur Conan Doyle, said that the action had been settled on terms which involved the payment by the defendants of an agreed sum as damages and costs to Sir Arthur Conan Doyle.

The article in John Blunt which was complained of was headed: "Conan Doyle Sensation. Famous Author Lifts Young Novelist's Plot. Plea for Belated Justice." Nothing which would lend emphasis to those headings was omitted from the article.

In the spring of 1925 a Mr. Symons published a book named "The Splendid Angel." Later in the year Sir Arthur Conan Doyle published a work called "The Land of Mist." It was alleged that Sir Arthur Conan Doyle had plagiarized Mr. Symons's book. In 1928 Mr. Symons published another book. called "The End of the Marriage Vow," and the article alleged that Sir Arthur Conan Doyle later published a work called "The Disintegrating Machine," and again "lifted" Mr. Symons's plot and ideas.

The fact was that Sir Arthur Conan Doyle's manuscript in both cases was in the hands of his agents before either of Mr. Symons's works saw the light. It was, therefore, impossible for him to have plagiarized Mr. Symons's work.

Mr. GILBERT BEYFUS, for Mr. Bottomley and the Phoenix Press, Limited. and Mr. OLIVER, K.C. (with him Mr. Horace Samuel). for Messrs. Upcott. Gill, and Son. Limited, said that their clients withdrew the suggestions that bad been made. and unreservedly apologized to Sir Arthur Conan Doyle.

MR. JUSTICE AVORY. — No doubt the parties have been well advised.

Solicitors. — Messrs. Field, Roscoe. and Co.: Messrs. Chatterton and Co.; Messrs. Rubinstein, Nash, and Co.
